Hindu Maintenance under Indian Law – Legal Overview

 Hindu maintenance laws in India are designed to ensure financial support to a dependent spouse, children, and parents. Maintenance aims to prevent destitution and uphold dignity, particularly for wives and children who are unable to maintain themselves. Maintenance under Section 125 CrPC

Section 125 of the Code of Criminal Procedure provides a quick and effective remedy for maintenance.

A wife, minor child, major disabled child, or aged parent may claim monthly maintenance if they are unable to maintain themselves and the respondent has sufficient means but neglects or refuses to provide support. 

Key Features:

  • Speedy and summary proceedings 
  • Applicable irrespective of personal law 
  • Maintenance may be awarded during pendency of proceedings 
  • Enforceable through Family Court or Magistrate Court

Maintenance under Hindu Marriage Act, 1955

 Section 24 – Interim Maintenance

Granted during pendency of divorce or other matrimonial proceedings to meet day-to-day expenses and litigation costs.

Section 25 – Permanent Alimony

Awarded at the conclusion of proceedings, either as:

  • Monthly maintenance, or 
  • Lump-sum settlement 

Courts consider income, property, conduct of parties, and standard of living.

Maintenance under Hindu Adoptions and Maintenance Act, 1956

 This Act specifically governs the right of maintenance for Hindus.

Who can claim maintenance:

  • Wife 
  • Widowed daughter-in-law 
  • Children (legitimate and illegitimate) 
  • Aged or infirm parents 

A Hindu wife is entitled to maintenance during marriage unless disqualified by law.

Maintenance for Wife, Children, and Parents

 Maintenance may be claimed separately or simultaneously under multiple laws, subject to adjustment.

Courts ensure:

  • Welfare of children 
  • Reasonable lifestyle for spouse 
  • Financial capability of respondent

 Maintenance petitions may be filed where:
